Acceptance of Terms
By accessing or using Sayy — including the website at sayy.io, the comment widget, the REST API, and the WordPress plugin — you agree to be bound by these Terms and Conditions. If you are using Sayy on behalf of an organization, you represent that you have authority to bind that organization to these terms.
If you do not agree with any part of these terms, you must not use the service.
The Service
Sayy provides an embeddable commenting platform that allows website owners to add real-time, context-anchored comments to their pages. The service includes:
- An embeddable JavaScript widget with four display modes (inline, floating, bottom bar, side panel)
- A management dashboard for site owners and team members
- A REST API for programmatic access to comment data
- A WordPress plugin for one-click integration
- Optional AI-powered moderation (Tier 2) via bring-your-own-key (BYOK)
- Import tools for migrating from Disqus, WordPress native comments, and WXR exports
Sayy is currently in early access (Q2 2026). Features, pricing, and availability may change as we iterate toward general availability.
Accounts
To use Sayy as a site owner or team member, you must create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
- You must provide accurate and complete registration information
- You must not share your account credentials with unauthorized parties
- You must notify us immediately if you suspect unauthorized access to your account
- You must be at least 13 years old (or the applicable age of digital consent in your jurisdiction) to create an account
We reserve the right to suspend or terminate accounts that violate these terms or that remain inactive for an extended period (12+ months with no API calls or dashboard activity).
Acceptable Use
You agree not to use Sayy to:
- Post, transmit, or facilitate content that is unlawful, threatening, abusive, defamatory, or otherwise objectionable
- Impersonate any person or entity, or misrepresent your affiliation with a person or entity
- Distribute spam, malware, phishing links, or unsolicited commercial messages
- Attempt to gain unauthorized access to other accounts, the Sayy infrastructure, or any connected systems
- Interfere with or disrupt the service, servers, or networks connected to Sayy
- Scrape, crawl, or harvest comment data from sites using Sayy without the site owner's explicit permission
- Use the service in any way that violates applicable laws or regulations
Site owners are responsible for moderating comments on their own sites. Sayy provides tools (spam filters, AI moderation, RBAC) to assist, but moderation responsibility ultimately rests with the site owner.
User Content
You retain ownership of any content you post through Sayy (comments, replies, reactions). By posting content, you grant Sayy a worldwide, non-exclusive, royalty-free license to host, display, and transmit that content as necessary to operate the service.
This license ends when you delete your content or your account, except where your content has been shared with others and they have not deleted it, or where retention is required by law.
We do not claim ownership of your comments. Site owners may export their comment data at any time via the dashboard or API.
Intellectual Property
The Sayy service, including the website, widget, API, brand, logo, and all associated software, is the intellectual property of Sayy. You may not copy, modify, distribute, sell, or lease any part of our service or software without explicit written permission.
The Sayy embeddable widget is provided under a license that permits its use solely for embedding comments on your website in accordance with these terms. This license does not extend to reverse-engineering, decompiling, or creating derivative works from the widget code.
Billing & Payments
Sayy offers both free and paid plans. Paid plans are billed monthly. By subscribing to a paid plan, you agree to the following:
- You authorize us to charge the payment method on file for the applicable subscription fees
- Subscription fees are non-refundable except where required by law
- We will notify you at least 14 days before any price increase takes effect
- Downgrading to a lower tier may result in the loss of features or data (e.g., analytics retention windows)
- If payment fails, we will attempt to retry for up to 14 days before suspending the account
AI moderation costs (Tier 2) are billed directly by your chosen AI provider (OpenAI or Anthropic) through your own API key. Sayy does not mark up or resell AI API usage.
API Usage
Access to the Sayy REST API is governed by your plan tier. You agree to:
- Respect rate limits as documented in the API reference
- Authenticate all API requests with valid credentials
- Not use the API in a manner that degrades service quality for other users
- Not redistribute API access credentials or build competing services using our API
We reserve the right to throttle or suspend API access for accounts that consistently exceed rate limits or violate these terms.
Availability & SLA
We strive to maintain high availability but do not guarantee uninterrupted access to the service. Sayy is provided on an "as is" and "as available" basis.
During the early access period, scheduled maintenance windows may occur. We will provide reasonable advance notice (typically 48 hours) for planned downtime via the Sayy status page and email notifications to affected site owners.
Formal SLA commitments will be introduced with the Business and Agency plans at general availability.
Limitation of Liability
To the maximum extent permitted by law, Sayy and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the service. This includes, without limitation:
- Loss of data, revenue, or profits
- Interruption of business
- Cost of procuring substitute services
- Damages resulting from unauthorized access to or alteration of your transmissions or data
Our total aggregate liability for any claims arising from or related to the service shall not exceed the amount you have paid to Sayy in the twelve (12) months preceding the claim.
This limitation applies to all causes of action in the aggregate, including breach of contract, tort (including negligence), strict liability, or any other legal theory.
Termination
You may terminate your Sayy account at any time through the dashboard settings. Upon termination:
- Your access to the dashboard and API will be revoked immediately
- The comment widget will stop loading on your site
- You may export your data for up to 30 days after termination by contacting support
- All data will be permanently deleted within 30 days of account closure
We may terminate or suspend your account immediately, without prior notice, if you violate these terms or engage in activity that could harm other users or the service infrastructure. In such cases, we are not obligated to provide a data export.
Governing Law & Disputes
These terms are governed by and construed in accordance with the laws of the jurisdiction in which Sayy is incorporated, without regard to conflict of law principles.
Any disputes arising from these terms or the use of Sayy shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, unless you are entitled to bring claims in small claims court.
You agree to bring any claims arising from the use of Sayy only in your individual capacity and not as a plaintiff or class member in any purported class or representative action.
Changes to These Terms
We reserve the right to modify these Terms and Conditions at any time. When we make material changes, we will:
- Notify registered users via email at least 14 days before the changes take effect
- Update the "Last updated" date at the top of this page
- Provide a summary of key changes in the notification
Continued use of Sayy after the effective date of changes constitutes your acceptance of the updated terms. If you do not agree with the revised terms, you must stop using the service and close your account.
